Terms and Conditions

All website and graphic designs or developments, including logos, artwork, scripts (free or otherwise), specific graphics, flash files or any other design content that is not owned by the client will remain the property of 'airsign-webgraphicdesign.co.uk' until such time that all monies owed are paid in full and a receipt has been issued. These are then either deleted or archived, depending on client wishes.

Client :
A company or individual requesting the services of 'airsign-webgraphicdesign.co.uk'.

Client Side:
The client will also agree to make available as soon as is reasonably possible to 'airsign-webgraphicdesign.co.uk' all materials required to complete the work to an agreed standard and within the set time frame, whether it be graphic artwork or website content. 'airsign-webgraphicdesign.co.uk' will not be liable for costs incurred, compensation or loss of earnings due to the failure to meet the agreed deadlines, nor will it be liable or become involved in any disputes between the owners, agents or their clients and cannot be held responsible for any wrongdoing on the part of those owners, agents or clients.

NOTE:
'airsign-webgraphicdesign.co.uk' will only work for clients who are 18 years of age or over.

Order:
By placing an order with 'airsign-webgraphicdesign.co.uk', you confirm that you agree with and will be bound by the terms and conditions.
An 'Order' is deemed to be a written contract between 'airsign-webgraphicdesign.co.uk' and the client 'you', either by a land mail or an email agreement (verbal contracts are not acceptable).

Disclaimer 1:
Whilst every endeavour will be made to ensure that the website and any scripts or programs are free of errors, 'airsign-webgraphicdesign.co.uk' cannot accept responsibility for any losses incurred due to third party malfunction.

Disclaimer 2:
Any scripts, cgi applications, php scripts, or software (unless specifically agreed and paid for) written by 'airsign-webgraphicdesign.co.uk' or provided by third parties will remain the copyright of 'airsign-webgraphicdesign.co.uk' and there respective owners.

Disclaimer 3:
'airsign-webgraphicdesign.co.uk' cannot take responsibility for any copyright infringements caused by materials submitted by the client. We reserve the right to refuse any material of a copyrighted nature unless adequate proof is given of permission to use such material.

Disclaimer 4:
Any additions to the original brief will be carried out at the discretion of 'airsign-webgraphicdesign.co.uk' and charges made by 'airsign-webgraphicdesign.co.uk' for such additions, when agreed in writing by the client.

Errors:
Any bugs, errors or other issues that are found on a website when it has gone live must be reported immediately, 'airsign-webgraphicdesign.co.uk' will look into (but is not obliged to) correcting these issues to meet the function outlined in the brief, but will not entertain any error that has been produced by forces outside of 'airsign-webgraphicdesign.co.uk' control i.e. external programs, viruses, third party scripts, or unauthorised content.

Internet Explorer:
'airsign-webgraphicdesign.co.uk' will endeavour to provide correct functionality with the web browser Microsoft Internet Explorer Version 6 and above. 'airsign-webgraphicdesign.co.uk' cannot offer a guarantee of correct function with all web browsers.

Web Hosting:
Whilst 'airsign-webgraphicdesign.co.uk' recommends certain website hosting companies, no guarantees can be made as to the availability or interruption of a website hosting service and cannot accept liability for losses caused by the unavailability, malfunction or interruption of this service, or for loss of turnover, sales, revenue, profits or indirect, consequential or special loss.

Illegal:
'airsign-webgraphicdesign.co.uk' reserve the right to refuse to work in any way with material which may be offensive, illegal or controversial, and will terminate any service should this be the case.

Payment :
A deposit (50%) is required from any client before any project work is carried out. Final payment is required to be paid in full, no later than 7 days from the date of the final invoice. There are no exceptions to this, whether the client decides they no longer want the material, or any outside forces preventing the material from being placed in its intended location, where a deposit for the project work is paid the client is still obliged to pay for the work that has been done. Non payment will result in legal action being taken. If an account is not settled, access to the related website will be denied and web pages removed, Registrars will be reported to Nominet and 'airsign-webgraphicdesign.co.uk' will then pass the case to the Small Claims Court to pursue payment, non payment can result in county court judgments (CCJ's) being added to the clients credit rating.

Complaints:
Anyone who experiences a problem with the design service provided should raise the matter directly using our online form, giving all information in relation to and where to locate the material (such as an url) and clearly outlining the grounds for complaint.
